Europees Hof bevestigt 'vervuiler betaalt'-principe

Operators with installations located close to a polluted area may be deemed to be liable for the pollution. It is not necessary to first carry out an investigation into the occurrence of the contamination or to establish fault on the part of the operator(s). The mere fact that installations are located close to a polluted area is enough to be held liable.
Moreover, national authorities can make the right of operators to use their land subject to the condition that they carry out environmental remedial measures.
