Collective actions and the financing of complex mass damage cases have been heavily debated in European civil justice. The Dutch collective damages procedure (WAMCA), effective since 2020, solidifies the Netherlands' leading role in this field. In this e-book the development and financing of collective actions under the WAMCA is assessed.
The authors delve into different funding modes, including market developments in third party litigation funding, and extensively address the question of the necessity, feasibility and possible design of a (revolving) litigation fund for collective actions.
